Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website at aplusnevadatrafficschool.com (the "Site") and the Nevada DMV–approved Traffic Safety Course (the "Course") provided by U Drive Better, LLC, doing business as A+ Nevada Traffic School ("we," "us," or "our"). By accessing the Site, enrolling in the Course, or clicking to accept these Terms, you agree to be bound by them.

Please read these Terms carefully. They include limitations on our liability and require disputes to be resolved under Nevada law in Clark County, Nevada.

1. Eligibility

You must be at least 18 years old to enroll in the Course and create an account. By enrolling, you represent that you are 18 or older, that any information you provide is accurate and complete, and that you are personally taking the Course for your own driving record or court order — not on behalf of any other person.

2. Description of the Course

The Course is a 5-hour online Traffic Safety Course approved by the Nevada Department of Motor Vehicles, designed to meet the requirements of NRS 483.700 through 483.780 and NAC 483.783. Successful completion may allow for the removal of up to 3 demerit points from your Nevada driving record, where authorized by your court or the DMV.

The Course is not a DUI School and does not satisfy any court-ordered DUI education requirement. The Course is also not a substitute for any minor driver education program. Acceptance of the Course for point reduction, plea agreements, or case resolution is determined solely by your court or the Nevada DMV.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, complete, and current information at the time of registration and to update it as needed. You must not share your account with any other person.

4. Pricing and Payment

The current Course price is displayed on the Site. All fees are charged in U.S. dollars at the time of enrollment. By submitting payment, you authorize us (and our payment processor) to charge your chosen payment method for the full amount.

Prices may change at any time. Any change will not affect enrollments completed before the change took effect.

5. Refunds

Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference.

6. Course Completion Requirements

To successfully complete the Course you must:

  • Personally complete all required Course modules and quizzes;
  • Personally pass the final examination (you may retake the exam an unlimited number of times);
  • Submit a notarized affidavit, as required by NAC 483.778, confirming that you personally completed the final exam; and
  • Provide accurate identification information for DMV reporting.

We provide the affidavit form and instructions. You are responsible for obtaining notarization, whether in person or through a licensed online notary service.

7. DMV Reporting and Certificate of Completion

Upon successful completion of the Course and receipt of your notarized affidavit, we will report your completion to the Nevada DMV and issue an official Certificate of Completion. You are responsible for delivering the Certificate to your court if your court requires a copy.

We do not guarantee that any specific court will accept the Certificate or grant any specific point reduction, plea reduction, or other relief. Acceptance is at the sole discretion of your court and the Nevada DMV.

8. Acceptable Use

You agree not to:

  • Share your account credentials with any other person;
  • Allow any other person to take the Course or final examination on your behalf;
  • Copy, reproduce, distribute, or create derivative works from any Course content;
  • Reverse engineer, decompile, or attempt to extract source code from the Site or Course;
  • Use the Site or Course in any way that violates any applicable law or regulation;
  • Interfere with, disrupt, or impose an unreasonable load on the Site, Course, or our infrastructure.

Violation of this section may result in immediate termination of your account, forfeiture of any fees paid, voiding of your Certificate, and notification to the Nevada DMV.

9. Intellectual Property

All content on the Site and within the Course — including text, graphics, video, audio, software, and design — is owned by U Drive Better, LLC or our licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You receive a limited, non-transferable, non-exclusive license to access and use the Course solely for your personal traffic safety education.

10. Third-Party Services

The Course relies on third-party services, including payment processors, learning management systems, hosting providers, and notary services. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services beyond what is required to deliver the Course.

11. Disclaimers

The Site and Course are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Nothing in the Course constitutes legal advice. If you require legal advice regarding your traffic citation, driving record, or court appearance, consult a licensed Nevada attorney.

12. Limitation of Liability

To the maximum extent permitted by law, in no event shall U Drive Better, LLC, its officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages — including without limitation loss of profits, loss of data, loss of driving privileges, denial of point reduction, court-imposed penalties, or any other intangible losses — arising out of or relating to your use of the Site or Course.

Our total cumulative liability arising from or relating to these Terms, the Site, or the Course shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or $100, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless U Drive Better, LLC and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your misuse of the Site or Course, or your violation of any law or third-party right.

14. Termination

We may suspend or terminate your access to the Site or Course at any time, with or without notice, for any violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Course immediately ceases. Sections that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law — will survive.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Nevada, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms, the Site, or the Course shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of those courts.

Before filing any claim, you agree to first contact us at support@aplusnevadatrafficschool.com and attempt to resolve the matter informally for at least 30 days.

16. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you by updating the "Last Updated" date and, where appropriate, by email to enrolled students. Your continued use of the Site or Course after the changes take effect constitutes your acceptance of the revised Terms.

17. Miscellaneous

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Site and Course. If any provision is held to be unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our prior written consent.
